Section 5 of the Indian Contract Act — when can a proposal be revoked, and does that apply if acceptance has been put in course of transmission?
Under §5 of the Indian Contract Act, a proposal can be revoked at any time before the communication of acceptance is complete as against the proposer — but not afterwards. Acceptance is "complete as against the proposer" when it is put into a course of transmission so as to be out of the acceptor's power. So if A posts an acceptance to B at 4 PM, B can no longer revoke after 4 PM — even if the letter hasn't arrived yet.
